By using our website or engaging our services, you agree to these Terms of Service. Please read them carefully before proceeding.

Our Services

Fusion Labs provides web development, design, and digital transformation services. The specific scope of each project will be clearly outlined in a formal Project Proposal before any work begins. Our core services include:

• Web Development: Custom websites and web applications
• Web MVP: Rapid prototyping and minimum viable product development
• Custom Software: Bespoke software solutions tailored to business needs
• SEO and Google Ads: Search engine optimisation and paid advertising campaigns
• Meta Ads: Social media advertising and campaign management
• Graphic Design: Branding, UI/UX design, and visual identity

Client Responsibilities

As a client, you agree to:

• Provide necessary materials, assets, and information in a timely manner
• Provide clear feedback and approve deliverables within agreed timelines
• Make payments according to the agreed payment schedule
• Respond to communications within 3 business days to avoid project delays
• Respect intellectual property rights and not use delivered work for unauthorised purposes

Payment Terms

All prices are exclusive of GST. GST at the applicable rate (currently 18%) is charged in addition to the project fee and will appear on your invoice.

Our standard payment structure is milestone-based:

• 40% advance payment to begin work
• 30% upon your approval of the design
• 30% upon project completion and launch

Payment milestones will be specified in your Project Proposal. Payments are collected via Razorpay, a PCI-DSS compliant payment processor. Accepted methods include UPI, debit/credit cards, and net banking.

Project work begins only after the advance payment is received and confirmed. Design work progresses to development only after the design approval payment is received. The completed project is handed over and launched only after the final payment is received.

Late or delayed payments will result in the project being paused until the outstanding payment is cleared. Fusion Labs is not liable for any business impact caused by delays resulting from outstanding payments.

Refund and Cancellation Policy

The advance payment (40%) is non-refundable once work has commenced, as it covers time and resources already allocated to your project.

If you cancel after the design approval milestone has been paid, the advance and design payments are non-refundable. You will receive all design files and work completed to that point.

If Fusion Labs is unable to complete the project due to circumstances on our side, a proportional refund of any unused advance will be issued.

No refunds are issued after the project has been launched and handed over.

Intellectual Property

All intellectual property rights in the delivered work (excluding third-party licensed materials, fonts, stock images, and open-source libraries) will transfer to you upon receipt of full and final payment. You retain ownership of all materials, content, and assets you provide to us.

Until full payment is received, Fusion Labs retains all rights to the work produced.

Project Timeline

We will provide estimated timelines for each project. Timelines depend on the timely receipt of materials, feedback, and approvals from you. Delays in client responses or approvals may extend the project timeline, and Fusion Labs is not liable for such extensions.

Warranty and Support

We provide a 30-day bug-fix warranty from the date of launch for issues directly caused by our work. This does not cover changes to scope, third-party plugin failures, or issues caused by client-made modifications after handover.

Ongoing support and maintenance services are available as separate paid engagements.

Confidentiality

Both parties agree to keep confidential information shared during the project private and not to disclose it to third parties without written consent.

Limitation of Liability

To the maximum extent permitted by law, Fusion Labs shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability in any matter arising out of these Terms shall not exceed the total fees paid by you for the specific project in question.

Termination

Either party may terminate the engagement with written notice via email. You will be responsible for payment for all work completed up to the termination date. Fusion Labs will deliver all completed work files upon receipt of payment for work done.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Rajasthan, India.
